In 2022, invocation of the Emergencies Act suspended the Charter Rights of Canadians for freedom of assembly and association.

We have been told that there is a legal opinion which justifies invocation of the Emergencies Act.

• This is a ‘known’.

We have also been told that we cannot see the content of this legal opinion due to attorney-client privilege.

• So that becomes an ‘unknown’.

So either we have a “known unknown” or an “unknown known”.  Rumsfeld would have been proud.

Any legal opinion purporting to justify the suspension of civil liberties should be public.  In a democracy laws do not exist in secret, protected by privilege.  Even whackdoodle crazies have civil rights.
