A Defence of the US Supremes
There are many reasons to criticize the US Supreme Court, but I think the label partisan is mis-guided. All Justices reject the partisan party label, and surely we can give some credence to their statements. After all, the are credible legal authorities of long standing. But why, one could ask, do the Judges seem to rule in a manner consistent with party positions? I offer the thought that, even in the United States, conservative in thought does not equal Republican thought, liberal thought does not equal Democrat thought. Yes, they are often the same, but not always. Prior to the Trump intimidations, for example, there were elected Republicans prepared to oppose the party line; not even partisans are unified. Remember the militant ‘originalist’ voices on the Supreme Court – Scalia for example. Originalism was not Republican thought; it stood (or fell) on its own. We should not be surprised that Republicans support conservative causes, Democrats, liberal ones. Parties grow out of societal, cultural or economic orientations.
